KUALA LUMPUR, Feb 19 (Bernama) -- A finance company manager was fined RM3,000 by the Magistrate's Court here today for using criminal force against a policeman who was on duty, by ramming the car that he was driving into the policeman’s motorcycle.
Magistrate Siti Radziah Kamarudin sentenced Chay Jee How, 27, after he pleaded guilty to the offence.
The court also ordered the accused to serve a five-month prison term should he fail to pay the fine.
Chay was alleged to have attacked or used criminal violence by ramming the car he was driving into the motorcycle that Lans Corporal Mohamad Hyder Umer, 31, was riding
He committed the act in Jalan Pahang as he was heading towards the Jalan Pahang roundabout at about 2am on Jan 14. The offence is punishable under Section 353 of the Penal Code which provides for a maximum imprisonment of up to two years or fine, or both.
Earlier, deputy public prosecutor Siti Nur Hajar Hamzah urged the court to mete out severe punishment that would serve as a lesson to the victim. However, lawyer Izzat Amir Saharudin who represented the accused, pleaded for leniency on the grounds that his client had a family to support and regretted his actions.
“At the time of the incident, the accused did not know the victim was a policeman on duty as he was dressed in civilian clothes. There was a misunderstanding and the accused thought that he was going to be robbed,” he added.
