Pakistani Man Among Five Fined For Illegal Dumping, Littering

MELAKA, April 15 (Bernama) -- Five individuals, including a Pakistani man, were fined between RM100 and RM10,000 by the Ayer Keroh Sessions Court here today after pleading guilty to charges related to solid waste management and littering in public places.

Judge Raja Noor Adilla Raja Mahyaldin imposed the sentence after Pakistani national Shah Sardar, 29, and four locals —Muhammad Aqil Sofidaliny, 26; Mohd Shahril Liwan, 43; Muhammad Syahmi Zulkipli, 32; and Mohamad Shafhan Mustapha, 28 — pleaded guilty to all charges read out against them.

For the main charge, Shah, was accused of dumping controlled solid waste, namely household waste, without permission on land in Mukim Batu Berendam on Feb 27, 2024 at about 10 am.

The offence was framed under Section 71(1) of the Solid Waste and Public Cleansing Management Act 2007 (Act 672), punishable under Section 71(8) of the same Act.

The four local accused were charged under Sections 77A(2) and 77B(1) of the same Act for disposing of cigarette butts in public places instead of in designated bins.

Muhammad Aqil committed the offence on a pedestrian walkway in front of a bank at Kompleks Perniagaan Al-Azim on Jan 15 at about 10.22am.

Muhammad Syahmi committed the same offence at Klebang beach on Jan 1 at about 4.43pm, Mohamad Shafhan at the front of Menara Taming Sari on Jan 2 at about 11am, while Mohd Shahril committed the offence outside a supermarket in Jasin on Jan 20 at about 11.40am.

SWCorp prosecuting officers Dewira Sherra Norman and Abd Hadi Abd Wahab sought deterrent sentences, particularly for the foreign national, arguing that the accused had long resided in Malaysia and should have understood the country’s laws.

Lawyer Casian Anthony, who represented Shah, pleaded for a minimum fine, citing family responsibilities, as well as recent employment and health issues. The local accused were unrepresented.

The court then fined Shah RM10,000, or six months’ jail in default. Muhammad Aqil and Muhammad Syahmi were each fined RM300 and ordered to perform 12 hours of community service, while Mohamad Shafhan was fined RM200 and ordered to complete eight hours, and Mohd Shahril was fined RM100 and ordered to complete four hours. 

They were ordered to complete their community service hours within six months.
