High Court Dismisses Application By Zayn Rayyan's Mother To Stay Prison Sentence

SHAH ALAM, Dec 23 (Bernama) -- The High Court here today dismissed an application by Ismanira Abdul Manaf to stay the five-year prison sentence imposed on her for neglecting her son, Zayn Rayyan Abdul Matin, two years ago.

Judge Datuk Aslam Zainuddin decided the matter after finding that there were no special circumstances that would allow the court to grant the stay of execution of the sentence pending the appeal.

"After examining the affidavits of the applicant and respondent, as well as the written submissions of both parties and hearing the oral submissions, the court ruled that the application for a stay of execution be dismissed because the court found that there were no special circumstances to allow it," he said.

The prosecution, as the respondent, was represented by Deputy Public Prosecutors Mohd Izham Ali and Ahmad Iqbal Azman, while Ismanira was represented by lawyers Haresh Mahadevan, Ramzani Idris and Lavanesh Haresh.

Ismanira, 30, filed the stay application last Nov 19.

On Oct 31, the Petaling Jaya Sessions Court sentenced Ismanira to five years in prison after she was found guilty of neglecting her six-year-old autistic child to the point of causing physical harm.

Judge Dr Syahliza Warnoh handed down the sentence after finding that the defence had failed to raise a reasonable doubt against the prosecution's case.

She ordered Ismanira to serve her prison sentence from Oct 31, in addition to signing a two-year good behaviour bond with one surety and a security of RM3,000.

‎Ismanira was also ordered to perform 120 hours of community service, to be completed within six months of completing her prison sentence.
