School Uniforms: Terengganu MB Wins Suit, Awarded RM200,000 In Damages
Judicial Commissioner Rosilah Yop who made the ruling in chambers held that the plaintiff had succeeded in proving his case against the defendants.
Ahmad, Mek Hawa Abdul Rahman and Hamie Azreen Ami Nordin, who were given contracts to supply school uniforms and stationery, filed the suit against the four defendants on Dec 15, 2011.
They named Dr Syed Azman, Harakah Daily permit owner Datuk Mustafa Ali and chief editor Ahmad Lutfi Othman, and publisher, Angkatan Edaran Enterprise Sdn Bhd as defendants.
The plaintiffs' lawyer Helmi Hamzah told reporters that the court had also ordered the four defendants to pay a total of RM200,000 in general and exemplary damages and RM 30,000 in costs to Ahmad.
Meanwhile, the defendants' lawyer Azhana Mohd Khairuddin told reporters that the court dismissed Mek Hawa and Hamie Azreen's claims on grounds that they had failed to prove their case against the defendants.
She said the court ordered the duo to pay RM30,000 in costs to the defendants.
Asked whether she would file an appeal over today's outcome, Azhana said she would seek her client's instructions regarding the matter.
The plaintiffs in their statement of claim, stated that Syed Azman had defamed them through an article under the heading, "Seleweng RM30 juta Bantuan Sekolah' (Embezzlement of RM30 million in School Aid) which was published in PAS' organ, Harakah, in its Nov 11-13, 2011 issue.
They sought general, special, aggravated and exemplary damages, costs and an injunction to prevent the respondents from continuing to publish the alleged defamatory article.
