Angkasa Fails To Maintain Suspension Order On Mustapa Kamal
Justice Datuk Zaleha Yusof upheld a Malaysian Cooperatives Tribunal decision after allowing preliminary objections by Datuk Seri Mustapa Kamal Maulut against a legal action by Angkasa to nullify the tribunal decision.
The judge held that Angkasa was not empowered to act against Mustapa Kamal as he was a non-member and because the apex cooperative had no provisions in its by-laws to act on the allegations against him. Zaleha also ordered Angkasa to pay RM6,000 costs.
The cooperatives tribunal had on June 12 last year struck out the suspension imposed by Angkasa on the Koperasi Ukhwah Malaysia Berhad chairman on Aug 25, 2010.
Tribunal chairman Hamidun Abdul Fatah in his decision said Angkasa had no jurisdiction to strip Mustapa Kamal of his right to participate in Angkasa's conferences or meetings during the period, as he was not a member of Angkasa.
Hamidun also said Angkasa failed to link Mustapa Kamal to its allegations that he had bribed certain members to vote him in as the president at Angkasa's 26th annual general meeting.
On July 12 last year, Angkasa filed the suit to nullify the tribunal's decision, claiming the latter had erred or was wrong in facts. It insisted that it had the power to take disciplinary action against Mustapa Kamal, and that its move did not breach any of its by-laws.
The plaintiff was represented by counsel S. Bindusha while Mustapa Kamal, by counsel Mahfuzah Mohd Faizi and Raja Norhajjah Raja Ahmad Shaari Ramozan.
